Terms of Service
The terms and conditions that govern your use of the Talem platform.
Acceptance of These Terms
These Terms of Service (the “Terms”) form a binding agreement between you and Talem EdHub Portal (“Talem”, “we”, “our”, or “us”), a business registered with the Department of Economic Development (DED) in Dubai, United Arab Emirates. By creating an account, accessing, or using the Talem website at talem.ae (the “Platform”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.
About Talem
Talem is a UAE-based platform that helps families discover, compare, and apply to nurseries, kindergartens, schools, and universities. We aggregate publicly available information about educational institutions, surface it through search and comparison tools, and forward enquiries and applications you submit to the institutions you choose.
We are not an educational institution. We do not admit, enrol, or accept students. Decisions on admission, enrolment, fees, and any other matter relating to a specific institution are made solely by that institution.
Eligibility and Account Registration
Age requirements
Account types
Talem supports three types of accounts: parents, students, and institution representatives. Institution representative accounts require additional verification before access to institution-management features is granted. You may hold only one personal account at a time. You may not impersonate another person or institution, or misrepresent your affiliation with an institution.
Account security
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at legal@talem.ae if you become aware of unauthorised access. The information you provide must be accurate, current, and complete.
Acceptable Use of the Platform
When using Talem you agree not to:
If you discover a security vulnerability, please report it responsibly to legal@talem.ae before disclosing it publicly. We will work in good faith to address the issue and will not pursue action against researchers who follow this process.
Reviews and User-Generated Content
Talem allows users to post reviews and other content about educational institutions. You retain ownership of the content you submit, but by submitting it you grant Talem a worldwide, non-exclusive, royalty-free, sublicensable licence to host, display, reproduce, adapt for formatting, and distribute that content on and in connection with the Platform.
Content standards
Reviews and other user content must:
Moderation (notice-and-takedown)
We do not review every piece of user content before it is published. If you believe a review or other piece of user content violates these Terms, please report it to legal@talem.ae with a link or screenshot and a brief explanation of the issue. We will review reports promptly and remove content that violates these Terms; we may also remove or edit content at our discretion, with or without notice, to comply with the law or to protect users, institutions, or the integrity of the Platform.
Enquiries, Applications, and Institution Decisions
When you submit an enquiry or application through Talem, we forward the relevant information to the educational institution you selected. We do not control whether the institution responds, when it responds, what it offers, or whether it accepts an applicant. Once an enquiry or application is forwarded, the institution becomes an independent controller of the data it receives, and that institution’s own policies and processes apply.
You agree that Talem is not responsible for any institution’s admission decisions, fees, communications, conduct, or omissions. Any contractual relationship arising from an admission is solely between you and the institution.
Documents you upload
An application may require you to upload documents — for example a passport copy, Emirates ID, birth certificate, school reports or transcripts, or vaccination records. Uploading is never required to browse, compare, save or enquire about a school; it is only needed to complete a formal application, and you can always apply to a school directly instead.
When you upload a document, you confirm that:
You grant Talem a limited licence to store, process, and transmit the documents you upload for one purpose only: operating your account and forwarding your application to the institution you selected. We do not use your documents for marketing, we do not sell them, and we do not share them with any institution other than the one you applied to.
Talem does not verify the authenticity of uploaded documents. We are a conduit, not an assessor: each institution carries out its own checks and makes its own admission decision. Submitting a forged, altered, or fraudulently obtained document may lead us to suspend or terminate your account, and may have consequences with the institution or the authorities that are outside our control.
We may refuse, quarantine, or remove a file that exceeds our size limit, is not an accepted file type, appears to contain malware, or is uploaded abusively. You can delete a document from your account at any time, and deleting your account removes your uploaded documents from our storage. Please note that once a document has been forwarded to an institution, that institution holds its own copy — deleting it from Talem does not delete their copy, and you would need to contact them directly.
How we handle these documents as personal data — including the fact that some of them are sensitive, that most relate to a child, and the consent we rely on — is set out in our Privacy Policy at /privacy.
Tuition Cashback
Talem may from time to time offer a tuition cashback benefit, under which a family that enrols at a participating institution through Talem receives back a percentage of first-year tuition. Any such offer is described on the relevant page of the Platform and is governed by these Terms together with the specific conditions published with that offer. Where the two conflict, the conditions published with the offer apply.
Cashback is not available as at the “Last Updated” date shown at the top of these Terms. It will operate only with participating partner institutions and only from the date we announce it. Registering interest, joining a waiting list, or submitting your email in connection with a forthcoming offer does not create an entitlement to any payment.
When cashback is earned
Where an offer is live, cashback is earned only if all of the following are true: you submitted the enquiry or application for that student through Talem before contacting the institution directly; the institution is a participating partner at the time of enrolment; the student actually enrols and the relevant tuition is paid in full to the institution; and the institution confirms the enrolment to us. Cashback is calculated on tuition only, and excludes registration deposits, one-off charges, transport, uniforms, examination fees, and VAT.
Payment and conditions
Where cashback is due, we pay it after the institution has confirmed the enrolment and after any refund or withdrawal window published with the offer has closed. The payment method and timing will be stated in the offer conditions. Cashback is payable to the person who submitted the enquiry, is not transferable, and cannot be exchanged for any other benefit. If the student withdraws, the enrolment is cancelled, or the institution reverses its confirmation, no cashback is payable, and any amount already paid becomes repayable to us.
We may change, suspend, or withdraw a cashback offer at any time. A change does not affect cashback already earned under the conditions in force when the enrolment was confirmed. We may withhold cashback where we reasonably believe an enrolment was submitted fraudulently, was duplicated, or was made in breach of these Terms.
Accuracy of Institution Information
Talem aggregates information about educational institutions from publicly available sources, including official regulator data (such as KHDA inspection reports), institution websites, public databases, and information provided to us by institutions themselves. We work to keep this information accurate and up to date, but we cannot guarantee that any specific piece of information is current, complete, or correct.
Before making any decision that depends on the accuracy of Platform information (for example, paying fees, accepting an offer, or relying on a deadline), you should verify the relevant facts directly with the institution. Talem is not liable for any loss arising from a decision made in reliance on information presented on the Platform.
Fee calculator and estimate tools
The fee calculator and any other estimate tool on the Platform produces an indicative figure only, generated from the fee data we hold at the time of calculation. It is not a quote, an offer, or an invoice. An estimate may exclude registration deposits, one-off charges, transport, uniforms, examination fees, sibling or early-payment discounts, and VAT where it applies, and the institution may change its fees at any time. Only the institution can tell you what you will actually pay. Do not rely on a calculated figure for budgeting or for any financial commitment without confirming it directly with the institution.
Intellectual Property
Our content
The Talem brand, logos, source code, design, copy, images we have created or licensed, and the structured database of institutions we have assembled are owned by Talem or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use them outside the Platform without our prior written permission, except for normal browser caching, fair-dealing use, and search-engine indexing.
Institution names, logos, and trademarks
Names, logos, photographs, and trademarks of educational institutions displayed on Talem belong to the respective institutions. We display them for the purpose of factual reference, comparison, and informational use. Their inclusion does not imply endorsement, affiliation, or any other commercial relationship.
Reporting Copyright or Trademark Infringement
If you believe that content on Talem infringes your copyright or trademark rights, please send a takedown notice to legal@talem.ae including the following:
We will review valid notices promptly and remove or disable access to the offending material if appropriate. We may also notify the user who posted the content and provide them with a copy of your notice; please bear that in mind when including personal information. We reserve the right to suspend the accounts of users who repeatedly infringe third-party rights.
Privacy
Our collection and use of personal information is governed by our Privacy Policy, available at /privacy. By using the Platform, you agree to the data practices described there.
Third-Party Services
The Platform integrates with third-party services, including Google (for optional sign-in), hCaptcha (for bot protection), Supabase (authentication and storage), Resend (email delivery), Vercel (hosting), PostHog (analytics), and Sentry / BetterStack (error monitoring). When you use those features you may also be subject to those providers’ own terms and privacy policies. Talem is not responsible for the availability, accuracy, or content of third-party services, or for any loss arising from your use of them.
The Platform may also link to institution websites and other third-party sites. We do not endorse those sites and are not responsible for their content, security, or practices.
Termination
You may close your Talem account at any time using the Danger Zone in your account settings, which initiates a permanent deletion of your data as described in our Privacy Policy. You may also stop using the Platform at any time without notice.
We may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have breached these Terms, if we are required to do so by law, or if continued access would create a risk to Talem, our users, or third parties. We may also suspend portions of the Platform from time to time for maintenance, security, or operational reasons.
Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Contact) will continue to apply after your account is closed.
Disclaimers
The Platform and all content on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. Talem does not warrant that the Platform will be uninterrupted, error-free, secure, free of viruses, or that any specific information or feature will be available at any given time.
We do not warrant the accuracy, completeness, currency, or usefulness of any information about an educational institution. As noted in Section 8 (Accuracy of Institution Information), you should independently verify any information you intend to rely on.
Nothing in these Terms is intended to exclude or limit any liability that cannot be lawfully excluded or limited under applicable UAE consumer protection law or under the consumer protection law of your country of residence where it applies to you.
Limitation of Liability
To the maximum extent permitted by law, Talem, its directors, employees, agents, and affiliates will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profit, loss of opportunity, loss of data, or loss of goodwill) arising out of or relating to your use of the Platform, even if we have been advised of the possibility of such damages.
Talem’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform, whether in contract, tort, or otherwise, will not exceed the greater of (a) AED 500, or (b) the total amount you have paid to Talem in the twelve months immediately preceding the event giving rise to the claim. As the Platform is currently provided free of charge, the practical cap is AED 500 unless paid services are added.
This section does not limit liability for fraud, fraudulent misrepresentation, gross negligence, or any other liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Talem and its directors, employees, agents, and affiliates from and against any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms or our Privacy Policy; (b) your misuse of the Platform; (c) your violation of any law or the rights of any third party; or (d) any content you submit to the Platform.
Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date at the top of this page shows when the most recent version took effect. For material changes (for example, a change to the limitation of liability or to the dispute-resolution process), we will notify you in advance by email and through a prominent notice on the Platform. Your continued use of the Platform after a change takes effect means you accept the updated Terms.
Governing Law and Disputes
These Terms, and any dispute arising out of or in connection with them or your use of the Platform, are governed by the federal law of the United Arab Emirates and the law of the Emirate of Dubai. The competent courts of Dubai have exclusive jurisdiction to settle any such dispute, except where mandatory consumer protection law in your country of residence provides otherwise.
Before commencing any formal proceedings, you agree to first contact us at legal@talem.ae and give us a reasonable opportunity to resolve the matter directly.
